Hello, does anybody know if we can refuse to have a park home owner join our Residents' Association.  I know that anyone working for the site owner is not allowed but am a bit vague about an actual resident.  We have some new people moving in shortly and already they are proving to be "difficullt", politest way to describe it really and have upset everyone here.  All the residents are refusing to have meetings if they are to join in so it is a very tricky situation.  Any thoughts appreciated, thanks.

Hi Labradorfan

The third criteria for becoming a Qualifying Residents' Association is that:

It must remain independent from the site owner, who together with any agent or employee of theirs is excluded from membership.

Hi Ed, thanks for your reply, have downloaded the Factsheet and we are a QRA. My problem is that this new person will definately want to join, however as each meeting is hosted in alternate residents homes and all the residents refuse to have him in their homes, how on earth can we continue?  As Secretary this makes my job almost impossible, apart from holding meetings al fresco, I have run out of ideas. The residents are not willing to discuss any business in front of this person, it seems already he is running back to the site owner reporting anything that is said to him so I can understand their point of view.  Very tricky situation, maybe we shall have to have 'Secret' meetings!!

There's often always one!!!

It often works the other way around as well. I built a park of some 24 homes and two of the new resident's, who were as nice as pie before they moved in, became the 'residents out of hell'! Everyone else was happy, but if a blade of grass grew in the wrong direction. the other two were up in arms.

I began to dread visiting this park and so eventually sold it. Had a sort of revenge though - one of them couldn't sell his home a few years later and so asked if he could advertise with us. I won't tell you what my reply was!

With regards to your situation, I would have to check, but I am wondering if you had a confidentiallity clause as one of your terms of membership and then if it could be proved that they weren't keeping to this (difficult!) they could be expelled.

Have to go up to Norfolk to work for the day today, but will see what I can find out tomorrow.

Have you considered holding your meetings off-site? I doubt if there is anything in your Constitution restricting location of these meetings.    Besides which, it is a good excuse for a get-together in an hospitable venue; and you don't need to let your problematic resident know where you are going or that you are even having a meeting!
