Evictions

#0, by meerkat, 18 July 2011 12:52 PM

A resident, who has rented the same single unit for over 14 years, has just been given notice to quit.   The owner has sold a twin unit and wants to site it on two single adjacent plots.   One is empty and one is rented by this tenant.  The site owner has never renewed the original short term tenancy agreement, but seems to think giving 4 weeks notice is all they have to do.

Am I right is saying this tenant is protected under law from eviction, and has sitting tenants rights?   I have advised them to keep paying their rent to the site owner, until they know precisely what their rights are.

Any advice would be very very welcome as the clock is ticking.

A simular situation happened on our park last year,, the tenant stayed put and contacted the local council homeless section where he was told that the landlord had to give him an 8 wks notice along with an AT6 form
, he was also told that if he was to stay on after the 8 wks the landlord would have to apply to the court for an eviction notice but as his rent was paid upto date and he hadn't caused any probs on the site and the only reason for the eviction was for the landlord to re-occupy the pitch the court may find in the tenants favour.
armed with all the information given to him and after several meetings with the local council he has been allowed to stay .....so maybe tell the resident to go the same way and get the council on side ..hope this is of some help .

Hello  meerkat  this  is  horrendous  the resident  in question  must  be  out  of  their  minds  with  worry, if  it  was  me  Id  make  an apointment with  CAB  as  soon  as  possible, the  fact  that  the  agreement  wasnt  kept  up  to  date  seems  like  the  site  owners  ace  card, but  as  you  say  the  tenent  is  still  paying  their  dues  on  time  each  month, maybe  this  issue  will  go  to  court  if  the  site  owner  pursues  an  eviction  order..........but  the  court  does  have  to  show  regard  for  all  circumstances, in  the  interest  of  both  parties...........also  the  tenent  can  ask  for  a  suspension  of  the  eviction  order  ( if  granted ) ...plus  they  can  go  back  each  year  to  request  the  same, so  all  isnt  lost,  I  also  agree  with  shazm1  about  getting  the  council  on  board......................at  the  end  of  the  day  tell  them  to  arm  themselves  with  knowledge  of  their  position ( the  CAB  and  the  council )....wish  them  luck  meerkat, sorry  I  cant  do  more   evergreen

Hi  meerkat  Ive  been  thinking  about this  problem  and  I  think  seeing  as  they  rent  this  home  as  their  permanent   residence  they  are  covered  by  The  Caravan  Sites  Act  1968 , maybe  if  they  have  internet  access  they  could  have  a  read  through  this, or  maybe  download  this  act  and  take  it  with  them  wherever  they  decide  to  get  help...good  luck  evergreen
