We have 2 mobile home parks adjoining each other owend by the same land owner, we have formed a association combining both parks and forwarded a letter informing the land owner , but the land owner said are we sure  two indepent parks can form one assosiation   we have over 50% from each park what else do we have to do

Hi Trev, think you may have to form 2 seperate Qualifying Res Assoc, one for each park to comply with the requirenents for QRA even though both sites are owned by the same person.   You can check criteria here http://www.direct.gov.uk/en/HomeAndCommunity/BuyingAndSellingYourHome/MobileHousing/DG_191088

Labradorfan may well be correct, but I don't think you will find the definitive answer you are looking for in the Government Park Home Factsheet: Qualifying Resident's Association, which you can download from our Download Page.

However, this Factsheet always talks of 'that particular site' and although from your post, the park owner seems to be working with you, I guess I would probably err on the side of caution and form two associations.

I don't think there would be any problem if you held your meetings together, but you would have to keep two sets of minutes and form your committee from the respective park. You would also have to vote seperately and not as a whole.

Thanks for your reply, when I said the land owner asked about combining both parks, they are not working with us ,they keep putting obsticals in place to delay us forming an association, we sent them a copy of our constunation and committee members only to be told they did not understand them. we will form 2 assocaition  with a committeees for each park, but as you said hold meeting together  and keep minunets for each park, and wait to see there reaction , will keep you informed

Hi Trev, best of luck with your site owner.  The Mobile Home Act does now require site owners to recognise QRAs'.  You need to write to your site owner to explain that you believe you are a QRA within the meaning of the legislation and request that the site owner recognises it as such within 28 days.

If the site owner fails to do so, the QRA can make an application to the Residential Property Tribunal www.justice.gov.uk for recognition, I think it cost £150 though!.  If the tribunal grants this, the site owner is then obliged to recognise your QRA.  

I am no legal expert but was in a similar situation to you and sought expert legal advice which did resolve things; it is always better to try to open a dialogue rather than resort to solisitors, sadly some poeple are just not reasonable. Best wishes.
