Hello  everyone, hope  all  is  well  on  this  crisp  november  day.....My  question  is ...On  some  parkhome  sites  they  have  to  close  for  a  cirtain  time  every  year..how  does  the  law  work  regarding  council  tax..is  it  based  on  the  fact  that  your  home  is  classed  as  your  main  residence ? but  would  the  site  licence be  a  holiday  licence..so  can  a  holiday  home  be  your  main  residence ?  evergreen

Only been a park home owner for 7 months so perhaps not fully knowledgeable of all the ins and outs of things but here is my take on things.......

If the site closes for some part of the year (usually Dec/Jan or parts of) then it is a holiday park and not a residential park home.
Residential park home is where the park home is your main residence, and you pay council tax as you would if you lived in a house, flat, bungalow etc.
On a holiday park you pay an annual fee to the park owner, what ever running costs the park owner has (including paying to the council for rubbish removal amongst other things) are included.
You normally cant have a holiday home as your main home. If you have a holiday home you have to have an other home which is your main residence.
If you make a holiday home your main home this could lead to major problems.....
one is you dont have the same sort of protection afforded to residential park home owners
and if the council finds out you are living in a holiday home as a permanent home, they can "evict" you from the site - leaving you homeless.

i will stand corrected, as I say its my take on things.

Hello  jah,  thankyou  for  your  reply  on  paper  this  is  correct, in  reallity   I  wonder !!  I  know  of  a  park..quite  a  large  park ... classed  as  a  "  holiday  park  "  residents  leave  for  2  weeks  of  the  year  " the  time  limit  was  reduced  in  consultation  with  the  council  "  these  homes  are  their  main  address.....some  living  there  for  years  !!!.......I  seriously  cant  see  the  council  evicting  these  people...surely  they  would  be  responsable  for  re-  houseing  them...........on  a  lighter  note  these  people  live  there  very  happy  with  the  arrangement.........a  lovely  site ...................  so !!  where  does  that  leave  the  rule  book !!     ................if I  could  afford  to  move  Id  be  there  tomorrow....evergreen

Jah you are wrong about what you say,the council WILL not evict you,there are two sites here in Weston park home where the close for two weeks and the people go on holiday or stop in a hotel

Their rent is expensive so they might aswell pay council tax thet have not got the protection as a residental site which needs a council certificate

The site owner can give them notice if he wants to sell the land,this has happened down Sand Bay with a caravan site they are building Park Homes om there

I did say the council CAN evict you.
Evergreen summed it up I suppose - what happens in reality may be different to what the "rules" say.

The number of people risking what is generally their largest asset has grown, indeed it is true.

It is like a time bomb waiting to go off! It will then be Round No 2, because it will always be the Park Owner's fault.

What were you saying Evergreen about the Local Councils don't evict you, I can list nearly twenty parks throughout the UK where this has happened over the last couple of years.. Get set for another click here.

The number of phone calls we get in this office from people asking why they can't live on a park for ten or eleven months is phenominal. Try as hard as we can to put people off, some of them still go ahead and you can bet when they get caught, they will blame the Park Owner, when  they had the chance to make the decision themselves in full knowledge of the facts.

Hello  Ed  I  didnt  actually  say  councils  dont !  evict  people...if  the  council  have  collected  tax  for  years..knowing  full  well  what  the  arrangement  is, then  surely  this  would  go  against  their  case...this  particular  site  has  about  60  homes...if  they  evicted  them  all ....where  are  they  going  to  re-house  them...a  friend  of  mine  has  been  on  the  council  list  6years.   You  also  infer  that  the  park  owner  always  gets  the  blame ...well  lets  be  honest  here  they  usually  are.."present  company  accepted  ".
Maybe  just  maybe  the  tide  is  turning  and  people  just  arnt  prepared  to  be  bullied  and  bossed  by  these  money  hungry  human  beings......................if  Joe  public  questions  the  laws..the  council  " maybe "  have  no  choice,  I  feel  that  your  right  in  respect  of  this  is  a  time  bomb  just  waiting  to  happen  but  not  only  this  issue,  but  many  issues.........my  last  comment  ......bring  it  on !!!!  evergreen
